商贸公司经营假冒五粮液被罚款2.5万元

　　去年9月6日，石河子市商务局执法人员在对位于石河子市天富名城附近的一家商贸公司例行检查中，发现该 公司内的地下库房内有四件五粮液没有酒类随附单，四件五粮液共计22瓶，货值16500元。




　　近日，法院一审判决：维持石河子市商务局对商贸公司作出的行政处罚决定书。


　　石河子市人民法院审理认为，石河子市商务局对认定商贸公司存在经营销售假冒五粮液的违法行为提供了现场 检查笔录、物品扣押清单、鉴定证明书等证据，证实石河子市商务局所作具体行政行为事实清楚，处 罚程序合法。
　　该商贸公司不服处罚，于今年8月17日向石河子市人民法院提起诉讼，要求商务局撤销对其作出罚款2.5 万元的处罚决定。
　　2010年11月5日，石河子市商务局对商贸公司作出行政处罚决定：没收假冒五粮液酒，并罚款2.5万 元。
　　次日，石河子市商务局对该商贸公司的法人代表赵某和该公司的员工贾某进行了调查。该商贸公司存在经营假 冒五粮液酒行为。
　　法庭上，商贸公司认为，这22瓶五粮液酒并不是公司的物品，而是公司负责人的朋友王某暂存在公司的库房 中，公司既没有把酒放在货架上销售，也没有批发。商务局仅在公司的库房中发现这批酒是假酒，就认定公司有销 售行为并作出处罚决定缺乏事实依据和法律依据。
　　石河子市商务局则认为，在商贸公司查出问题酒后，2010年9月9日和10日，执法人员分别对商贸公司 的当事人贾某和法人代表赵某进行了调查核实，从调查笔录中记录的事实，可以确认商贸公司存在经销假冒酒的违 法行为。商务局按照相关法律规定和处罚程序规定，进行立案调查、集体审议并依法举行了听证会，并对商贸公司 在听证会上递交的代理意见书进行审查后，认为商贸公司提出的事实、理由不成立，最终依法作出行政处罚决定书 。商务局认为行政执法程序合法有效,监听软件，适用法规正确,手机窃听器材。
