小偷进厂盗窃被抓 老板要其零薪打工一月赎罪

　　小毛贼许某到一家工厂偷东西时，被老板抓住了，老板为了教育小偷，给了他两个选择：要么将他送往当地派 出所；要么在厂里“零薪”打工一个月。许某选择了“零薪”打工一个月。

　　昨天，是许某在温州龙湾一家鞋革加工厂“工作”的第28天，这一个月之后，他说，出厂后再 也不偷了。

　　老板给出两个选择

　　许某今年21岁，老家在安徽，一直靠在温州龙湾打点零工过日子。

　　1月5日凌晨2点，许某来到温州龙湾区瑶溪镇龙东村，口袋空空的他看见这里有家鞋革加工厂 。

　　“我偷点东西去卖，或许手头能宽裕点。”许某马上行动了，就在他快要得手时，被该厂的工人发现，许某当 场被抓，被送到了老板林先生的办公室。

　　“有人到厂里偷东西，该怎么办？”林先生看着眼前的毛头小子，犹豫了。如果把他送进派出所，小伙子还年 轻，而且许某属于偷盗未遂，即使送到了派出所，许某面临的惩罚也就是拘留数天，这样的惩罚未必会有效果，那 么怎样才能更有效呢？

　　最后林先生给了许某两个选择：一是将他送往派出所；二是在厂里“零薪”打工一个月。

　　苦干一个月，只为洗心革面

　　许某听了后，想也不想，就选择了第二条路。

　　该厂与许某订立了口头协议：许某在工厂零薪工作一个月；工厂免费提供吃住，一个月期满后，许某可自行离 开。当天，根据厂里的要求，许某交出了他的身份证、手机及身上财物，随后就开始了第一天的“工 作”。

　　28天的时间，许某吃、住都在工厂里，在工厂内行动还算自由，没有受到什么约束，作息时间与其他工人一 样。唯一不同的是，他不能离开工厂半步。工作时，他做的大多是搬运货物之类的体力活。

　　许某说，这一个月来，虽然工作强度挺大，但与被扭送到公安机关留下案底相比，他还是愿意接受这样的惩罚 。他还说，出厂后，再也不偷了，准备找份工作好好干。既然老板给了他机会，他会好好珍惜，重新 做人。

　　网友支招：带薪其实更好

　　林先生说，许某在厂里的表现还不错，因为他只是说许某是新进的员工，所以多数员工并不知道许某进厂的原 因，大家同住同吃，并没有什么两样，有些员工还特别照顾许某。

　　“他自己选择了在工厂里零薪打工一个月，用高强度的劳动代替惩罚。我想通过这样的方式，让他认识到偷盗 是可耻的。”林先生说。

　　但是，浙南律师事务所陈一来律师表示，无薪干活属于强迫劳动。从法律上讲，鞋厂老板不是行政机关，没有 执法权。林先生的正确做法是，要么扭送公安机关；要么放人。

　　此事在当地引发不少议论，网上讨论也很多。多数网友表示，林先生的做法很妙，但既然小偷已经悔过了，那 就给他点钱，既当工资，又当奖励吧。
